Cusack Legal Services can assist lawyers and individuals to deal with emergencies involving family law. We impartially represent the interests of both male and female litigants. From time-to-time emergency situations arise that require immediate action. Civil Litigation Emergencies photoIf an individual has been served with documents requiring attendance at court or participation in a step in a family law case within a short time frame — typically within a few days — that is an emergency. There are many kinds of emergencies — they may involve motions that are scheduled by either party with little notice, case conferences, mediation, examination for discovery or examination on an affidavit. In family law cases they frequently involve case conferences or motions to deal with:

  • interim custody of children
  • child or spousal support
  • removal of a spouse or partner from a family home when violence has occurred or has been threatened
  • preventing the removal of children from their usual home by one parent; or,
  • preventing a spouse from disposing of assets.

Cusack Legal Services can provide assistance for litigants who are faced with a family law emergency and who:

  • do not have a lawyer;
  • have a lawyer, but the lawyer is not available to deal with the emergency due to scheduling conflicts, illness, absence or for other reasons
  • have a lawyer, but the lawyer does not handle family law cases — for example, if the lawyer only handles real estate transactions or corporate law matters

If you are a lawyer with a client who is facing a family law emergency, Cusack Legal Services can assist you if:

  • you are not available to deal with your client's emergency due to scheduling conflicts, illness, absence or for other reasons; or
  • you do not handle family law matters.

In such cases, we'll help you deal with the emergency and then refer the client back to you for any other services.

The amount of assistance we can provide will depend upon the amount of time available to deal with the emergency and the nature of case. In most cases Cusack Legal Services can:

  • meet with the client or the referring lawyer to determine the facts of the case
  • prepare, serve and file documentation dealing with the emergency
  • participate in the motion, case conference, mediation or cross-examination
  • attend at court on behalf of the client or the referring lawyer
