Examples of Wills and Powers of Attorney Emergencies

The case:

An elderly gentleman was terminally ill. He was bed-ridden and the hospital had discharged him to the care of his family at his home, in anticipation of his death. The gentleman did not have a Will. Despite his illness he was still mentally competent and capable of making a Will.

The emergency:

To resolve this urgent matter Cusack Legal Services sent a lawyer to the gentleman's home to take his instructions. The Will was prepared, and within 24 hours it was signed on a return visit to the home.

The case:

A woman who had been a long-term client of Cusack Legal Services was unexpectedly found to be suffering from terminal cancer, and advised that she had only weeks to live. She was hospitalized and receiving palliative care, but remained lucid and competent to make a Will.

The emergency:

Cusack Legal Services responded to an urgent request by having a lawyer meet with the woman at the hospital, take her instructions and return to the hospital to have the Will executed, all within 48 hours.

The case:

A young man who had been diagnosed as having terminal cancer had been advised by his doctors that he had approximately 2 weeks to live. To ensure that his affairs were in order for the benefit of his wife, he asked Cusack Legal Services to prepare his Will.

The emergency:

The client's instructions were taken, the new Will was drafted and signed by the client within 3 days after the initial meeting.
