If an individual is struggling with a terminal illness or is about to undergo surgery and does not have a current Will and Powers of Attorney in place, that is an emergency. Typically, the documents must be prepared and signed within a very short time — usually within days, and sometimes within hours. This can involve one or more visits to a client at his or her home or in a hospital to ensure that the documents are completed and signed while the client's mental and emotional capacity to make a Will and Power of Attorney remains undiminished.

A lawyer from Cusack Legal Services can:

  • meet with the client and form an initial opinion as to whether he or she has the mental and emotional capacity to make a Will and a Power of Attorney
  • take the client's instructions
  • draft the Will and Power of Attorney
  • meet with the client to review the draft documents and ensure that the client understands them and approves the contents
  • meet with the client to have the Will and Power of Attorney signed and witnessed

If you are an individual who requires a Will and Powers of Attorney to be completed on an emergency basis, Cusack Legal Services can assist you if you:

  • do not have a lawyer;
  • have a lawyer, but the lawyer is not available to deal with the emergency due to scheduling conflicts, illness, absence or for other reasons;
  • have a lawyer, but the lawyer does not handle Wills and Powers of Attorney — for example, if the lawyer only handles real estate transactions, corporate law matters, civil litigation or family law cases.

And if you are a lawyer with a client who requires a Will and Powers of Attorney to be completed on an emergency basis, Cusack Legal Services can assist you if:

  • you are not available to deal with your client's emergency due to scheduling conflicts, illness, absence or for other reasons; or,
  • you do not handle Wills and Powers of Attorney.

In such cases, we'll assist you to deal with the emergency and then refer the client back to you for any other services.
